Jury Tells McDonald’s to Pay Woman $6.1 million

McDonald’s has been found guilty of negligence in the case of Louise Ogborn, 21, who sued the fast-food retail giant after being sexually assaulted in April 2004. An unknown person impersonating a police officer contacted the Mount Washington restaurant by telephone and claimed that a female employee – fitting Ogborn’s description – had been accused of stealing property. The caller demanded a “female” employee be stripped searched.

Donna Summers, who was Ogborn’s assistant manager at the time, allowed her then-fiancee, Walter Nix, Jr., to lock Ogborn into a small room at the back of the restaurant, where for the next three hours, Nix repeatedly sexually assaulted Ogborn. Nix is serving 5 years in prison for his role in the attack on Ogborn.

Summers was placed on probation for a misdemeanor conviction in relation to the incident.

Ogborn sued McDonald’s Corp., claiming the fast-food giant failed to warn her and other employees about the caller – who had already struck other McDonald’s stores and other fast-food restaurants across the country – and the jury agreed, awarding Ogborn a $6.1 million verdict. McDonald’s is presently considering to appeal the ruling.
